In this Terms of Use ("Terms") we describe the terms of usage for Allena mobile applications, software, websites, APIs and services (collectively, "Allena"). You accept these Terms by using any part of Allena. If you do not accept these terms, do not use any part of Allena.

Additionally, you cannot access or use Allena if you are barred from receiving services under the laws of any applicable jurisdiction or have previously been suspended or terminated from Allena.

About Allena

Allena is a service developed and provided by Allena AS. The service is available online in the Apple App Store as 'Allena'. Allena provides camera-counted fitness games, ranked competition, and exercise feedback.

Health

You are responsible for your own health. Allena AS is not a medical organization and we will not provide you with any medical advice or diagnosis. Information made available through Allena and our partners and affiliates shall solely be used for recreational and educational purposes.

Consult your doctor before using Allena, and if you experience any pain or discomfort. Allena AS cannot guarantee any health, weight and/or fitness results or improvements. Allena is only intended for healthy adults. Please do not use Allena if you suffer from, or might suffer from, any medical condition that may be impaired by exercise.

Allena AS is not responsible for any personal injury or any damages that may have been the result, direct or indirect, of any use or misuse of Allena.

Usage of Allena

Allena uses the camera to count repetitions and, for supported exercises, report signals such as squat depth and knees moving inward. Allena AS does not guarantee that this functionality will operate as intended, and we do not assume any responsibility for improperly performed exercises, incorrect measurements, incorrect notifications, or injuries that may occur. It is essential for users to understand the proper techniques and precautions associated with the physical exercises before using the app. In using this app, users agree that any liability, loss or damage that occurs as a result of the use of this app, including but not limited to any reliance on the accuracy, completeness, or usefulness of the exercise suggestions or notifications, is solely at their own risk.

Your Account

To use some parts of Allena, you need to create an account. You are responsible for all activity that occurs in association with your account. Allena AS is not liable for any loss or damages caused by your failure to maintain the confidentiality of your account credentials. In order to create an account you must be over the age of 18. Allena AS does not permit usage of Allena to persons under the age of 18.

Termination

You agree that Allena AS has the right to suspend or deactivate your account or access to certain parts of Allena at any time and without notice or liability to you. Upon such termination we might delete your account and other information related to your account.

Reasons for such termination include violations of this agreement and requests from law enforcement or other government agencies, but are not limited to these.

Rights

Allena AS grants you a limited, non-exclusive, non-sub-licensable, non-transferable and revocable license to access and use Allena as long as you do not copy, modify, reverse engineer, or otherwise attempt to discover any source code, sell, sublicense or otherwise transfer any right in Allena, except where allowed by law. You agree to only access Allena through interfaces provided by Allena.

All rights in and to Allena, including any trademarks, service marks, trade names and copyrighted content (collectively "Intellectual Property") presented within Allena are the property of Allena AS and/or third parties. You agree not to use Intellectual Property for any other purposes except for your own use of Allena unless required otherwise by applicable mandatory law.

You are not entitled to assign your rights and/or obligations under these Terms to any third party without Allena AS's prior written consent. Allena AS is entitled to assign its rights and/or obligations under these Terms.

Allena AS reserves the right to refuse access to Allena to anyone, for any reason, at any time.

Allena AS reserves all rights not expressly set forth in these Terms.

Disclaimer and limitation of liability

You use Allena at your own risk. Allena is provided "AS IS", without any warranties, and Allena AS does not warrant that Allena and availability thereof will be uninterrupted or error-free. Allena AS does not assume any responsibility for errors or omissions in the information or software or other documents, which is referenced by or linked to. References or links to third parties' websites are provided "AS IS", without warranty of any kind, either expressed or implied.

In no event shall Allena AS be liable for any indirect or consequential damages, except in cases of intentional misconduct or gross negligence. To the maximum extent permitted under applicable law, Allena AS's aggregated liability for any direct damages shall be limited to the lesser of: (1) membership fees paid by the user; (2) membership fees paid by the user during the previous calendar year; or (3) 5 000 NOK.

Applicable law and jurisdiction

To the extent that these Terms allow you or Allena AS to initiate litigation in a court, both you and Allena AS consent to the exclusive jurisdiction of the Oslo courts and Norwegian law. You and Allena AS agree that all claims and disputes (whether contractual or otherwise), arising out of or relating to the Terms or User Agreement will be litigated exclusively in the Norwegian public courts, whereby the District Court of Oslo shall be the court of first instance.

General

Allena AS may update the User Agreement at any time. If we make an update that impacts either party's rights or obligations, we will let you know approximately 30 days before the update goes into effect. If you keep using our services after the 30 days, you are agreeing to our updated User Agreement. If you do not want to agree, you must stop using our Services.
